How High Is 400 Feet – While we may enjoy flying, it is a nightmare for air traffic controllers and pilots flying manned aircraft.

Consumer drones pose a real threat to manned aviation, which is why authorities have placed restrictions on drones’ flight altitudes. So, how high can a drone fly?

In the US and most countries, you can fly your drone up to 400 feet above the ground. This limitation is defined in 14 CFR part 107 and is referred to as the 107 rule.

In this blog post, we’ll take a closer look at these drone height restrictions, how they’re enforced, and the reasons behind them. Let’s begin.

Any collision between a manned flight and a drone could result in a human catastrophe. The FAA has had to impose height restrictions on commercial and recreational drones.

A study by the Bard College Drone Research Center reported 327 closed encounters between unmanned drones and commercial aircraft between December 2013 and September 2015.

In one incident (see video below), a drone flew very close to a helicopter, which could have resulted in an unfortunate incident.

Cases like these force the FAA to enact new, stricter regulations and enforce existing ones. One of these rules is the famous “400 foot height limit” rule, which we will discuss and understand here.

If you’ve owned and operated a drone or other unmanned aerial vehicle in the US, you’ve probably heard of FAA Regulation 107, which clearly states how pilots should operate unmanned aircraft systems (UAS).

This rule ensures that it does not threaten US airspace for other flights. Legal language is often difficult for the average person like you and me to understand, so let’s first look at what the rules say and how we can interpret them to make sure we follow them.

Rule 107 provides many guidelines for the safe use of drones, but subsection 51(b) of the rule expressly addresses drone altitude limitations. It states that;

A small unmanned aerial vehicle may not exceed 400 feet above the ground unless the small unmanned aerial vehicle: (1) flies within 400 feet of a structure; and (2) not fly more than 400 feet above the immediate upper boundary of the structure. Exceptions to the 400-foot height limitation

There are exceptions to this rule. You can go up to 400 feet above the ground if you are within 400 feet of tall structures such as buildings, telephone towers, etc.

You must be wondering why the limit is 400 feet and not some other random height? What happens when you fly your drone over 400 feet?

All manned aircraft must be above 500 feet above the ground, except in controlled airspace near airports. The FAA leaves a 100-foot buffer zone to eliminate all “almost any” cases, and sets 400 feet as a red line above which drones cannot be flown.

Statistics also show that most drone incidents occur at an altitude of 500 feet. So a 400-foot limit and a 100-foot buffer zone make flying safer for both manned aircraft and drones.

It is important to understand that the restrictions imposed by Regulation 107 only apply in uncontrolled airspace. So what is controlled and uncontrolled airspace?

Controlled airspace is an area within 5 miles of an airport. Any unauthorized flight activity by civil servants is restricted in this area.

I have used the word “restricted” here because it is not completely prohibited. After obtaining a LAANC permit from the FAA, you can fly your drone in these areas.

LAANC (Low Altitude Authorization & Notification Capability) is an automated authorization process that users can use on their phone app and obtain authorization in real-time.

The process is fully automated and multiple data points are checked before approval is given to ensure the area is safe for drone operations.

Once authorized through the app, you do not need to notify air traffic controllers unless specifically requested to do so. Just follow the provided flight plan and enjoy.

One important thing to note here is that the exception to the 400-foot rule around tall buildings no longer applies in regulated areas.

Even if you are near a tall structure, you still need to keep your drone below the 400 foot limit as measured from the ground. The LAANC permit states the following;

The height limit is an absolute value above the ground that cannot be added to the height of any building. Uncontrolled airspace

When flying in uncontrolled areas, you must comply with Rule 107 restrictions on altitude, speed, line of sight, and other aspects of safe drone operation.

This is one of the most misunderstood aspects of Rule 107. Where should you measure the 400 foot height limit?

But there are situations where this can be difficult. For example, you are standing on top of a hill that is 90 feet above normal ground.

Should your current clearance be adjusted to 310 feet (since your launch point is already 90 feet above the ground) or are you still allowed to climb to 400 feet?

I looked up the FAA rules and guidelines and crawled through various communities but couldn’t find a clear explanation for this.

Your reference point of 400 feet should be the starting point because the airplane is constantly adjusting its altitude when an obstacle such as a mountain top is present.

Since airplanes are not allowed to fly less than 500 feet from the nearest surface (ground or other structure), the airspace above you is safe up to 400 feet from takeoff.

If you are at the top of a hill and you go 400 feet from the top of the hill (your starting point), remember that you must stay within 400 feet in ALL directions so that you cannot keep 400 feet from the top of the hill. hill and circle in one direction, making safe airspace.

Airplanes can only adjust their altitude near the top of the mountain, but they can still fly lower than the mountain, making the possibility of a collision real.

Rule of thumb: Fly below 400 feet above the ground and always use best judgment when in doubt. Don’t take risks that could harm other people.

Most advanced drones have an altimeter and display the drone’s height on a smartphone or controller screen. But if you want to know how long 400 feet is, the infographic below should give you a rough idea.

If you are relatively new to the world of drones or have never flown one before, you must be wondering how far a drone can technically fly.

Technically, most top-of-the-line drones can easily fly up to 10,000 feet. Above that, the air pressure drops enough for the propeller to generate enough thrust to reach a higher altitude.

Most well-known drone manufacturers, such as DJI, have programmed their drones to always stay within the 400-foot limit from the launch point. This provides an additional safety feature in case you accidentally cross the red line.

But remember, it’s not easy. The software measures the height from the starting point, so if you’re standing on top of your favorite structure or hill, that’s the drone’s zero point, and it can still exceed the maximum allowed limit.

Most modern utility drones are capable of climbing for a big fight. For example, the DJI Mavic 3 has gone to the top of Mount Everest. Also, mid-range drones like the DJI Mini 3 can reach up to 5,000 meters.

Most modern drones have other safety restrictions programmed into them. One of my favorites was DJI’s 2015 firmware update that prevented its drones from flying over metropolitan Washington DC.

This happened after the new pilot crashed his Phantom 2 on the Whitehouse grounds, damaging some tree branches and possibly scaring some Secret Service agents.

Since hobbyists use drones not only for the fun of flying and aerial photography, they have found application in many professional fields.

One of them is the inspection of tall structures. The FAA has a commercial drone licensing program and specialty waivers for commercial pilots.

For example, if a skyscraper is being built, drones can easily inspect the work from above, instead of sending workers there to inspect (cheaper and safer).

Now, in an uncontrolled area 5 miles from the airport, Rule 107 allows climbing an additional 400 feet above the highest surface of the structure without a permit.

But if the skyscraper is built in a controlled area, you need to apply for a special permit (this is different from the LAANC discussed above).

The FAA has strict rules for issuing these special permits, and the entire process can take up to 3 months in some cases. Air traffic controllers must be notified two days before the planned operation.

If you’re an aviator like me, you now have a height limit of 400 feet within a controlled area (after your LAANC clearance) and a general limit of 400 feet outside of a controlled area (including tall building exemptions).
